Pennsylvania Stalking/Harassment Penalties

Stalking is a Misdemeanor 1 under Pennsylvania law if it is a first offense, which carries a maximum of 5 years in prison.

If you are facing a 2nd offense stalking charge or have a prior domestic violence conviction on your record, you can be charged with a Felony 3, with a maximum penalty of 7 years in prison.

Harassment may be a Summary Offense or a Misdemeanor 3, depending on how it is charged. A 3rd degree misdemeanor carries a maximum penalty of a year in jail.
