In Pennsylvania, careless driving
and reckless driving are serious traffic offenses. These
charges are much more serious than a simple ticket. A simple traffic

PA Careless Driving Laws
You may be found guilty of a careless driving
offense if you are found driving in a manner that shows careless
disregard for the safety of others. This is a summary offense,
similar to a ticket. It is punishable by up to 90 days in jail and
fines. You will also suffer 3 points on your driver’s license for
this offense.
Falling asleep while driving is also charged as
careless driving.

PA Reckless Driving Laws
You may be charged with reckless driving if you
drive with willfull or wanton disregard for the safety of
persons or property. Similar to careless driving, this is a summary
offense. You may serve up to 90 days in jail as well as a fine of at
least $200.
This offense will also land you a 6 month
suspension of your driving privileges. If you incur three or more
reckless driving charges you will lose your license for 5 years.

It is important to note that if, in your driving, you
injure someone you can be charged with assault.
Your vehicle can be considered a deadly weapon and you could be
facing far more serious felony charges.
Assault with a deadly weapon can land you in
prison for up to 10 years.
Both careless and reckless driving are very
broad offenses. There are many driving behaviors that could be
considered careless and reckless.
In cases like these, we may be able to argue that your driving was neither
careless nor reckless and get your traffic citation dismissed.
Fleeing or Attempting to Elude a Police Officer
This offense happens when you fail to stop for
an officer who has signaled you to pull over. Fleeing or attempting
to elude is a 2nd degree misdemeanor punishable by up to
2 years in prison.
